Refund Policy

1. Principles of Engagement
At Elixios, we provide bespoke professional services. Unlike physical commodities, the value we provide is based on creative labor, specialized engineering, and high-level strategic consulting. Once resources are allocated and work has commenced, the time and effort invested cannot be retrieved.
By signing a Service Agreement or making an initial payment, you acknowledge that you have reviewed and accepted this Refund Policy in full. This policy is designed to protect both the Client's investment and the Agency's operational stability.
2. Strict Non-Refundable Items
The following items are strictly excluded from refund eligibility under all circumstances:
Commencement Deposits
The initial 50% deposit (or the agreed upfront amount) is non-refundable. This covers project setup, research, discovery, and the opportunity cost of blocking our team's schedule.
Approved Milestones
Once a milestone (e.g., Wireframes, UI Design Phase, MVP Alpha) has been signed off or approved in writing, the associated payment is final and non-refundable.
Third-Party Licensing
Any costs incurred for domain registration, hosting servers, premium APIs (e.g., OpenAI, Stripe), font licenses, or stock photography are immediate and non-refundable.
Time-Based Consulting
Strategy sessions, technical audits, and high-level consulting are billed based on time and expertise. Once the session has taken place, fees are non-refundable.
3. Limited Refund Eligibility
In extremely rare circumstances, a partial refund may be considered at the sole discretion of Elixios management:
- Early Cancellation: If a cancellation is requested within 24 hours of payment and *no work* has been performed (including discovery or research), a refund may be issued minus a 15% transaction and processing fee.
- Service Incapacity: If the Agency becomes unable to perform the agreed-upon services due to internal catastrophic failure before a specific phase begins, the Client may be eligible for a refund of that specific unstarted phase.
4. Project Abandonment
If a Client becomes unresponsive for more than 15 business days without prior written notice, the project will be considered "Abandoned." Abandoned projects are terminated immediately, and all payments made to date are forfeited. Re-starting an abandoned project requires a new Service Agreement and a 20% "Re-activation Fee."
5. Satisfaction & Revisions
We do not offer refunds based on subjective taste or "change of mind." Our process includes built-in review rounds to ensure alignment:
- Clients are provided with specific "Revision Windows" for each milestone.
- Failure to provide feedback within the window constitutes approval of the current state.
- Subsequent requests for changes after approval will be treated as "Out of Scope" and billed separately.

To initiate a formal refund review, the Client must follow these exact steps:
7. Chargeback Prohibition
The Client agrees not to initiate a chargeback or payment dispute with their bank or payment processor.
Initiating a chargeback is considered a breach of contract. If a chargeback is initiated, the Agency reserves the right to report the incident to credit bureaus, pursue legal recovery for the full project amount plus 30% legal fees, and immediately terminate all active licenses and hosting for the Client's project.
8. Modification of Policy
Elixios reserves the right to modify this Refund Policy at any time. Modifications will be effective immediately upon posting to this website. It is the Client's responsibility to check for updates.
